Mark My Prompt is a web-based platform that allows users to save, organize, search, and manage AI prompts. The service includes features such as:

  • Storing and organizing prompts with tags and folders
  • Searching and filtering prompts
  • Sharing prompts publicly or keeping them private
  • Accessing prompts via API
  • AI-powered features for tag generation and prompt improvement

4. User Accounts

To use Mark My Prompt, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your account information to keep it accurate
  • Maintain the security of your account credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

5. User Content

You retain ownership of all content you create, upload, or store on Mark My Prompt ("User Content"). By using the service, you grant us a non-exclusive, worldwide, royalty-free license to:

  • Store, process, and display your User Content to provide the service
  • Use your User Content to improve our services and develop new features
  • Back up and maintain your User Content

You are solely responsible for your User Content and warrant that you have all necessary rights to use, store, and share such content. You agree not to upload content that:

  • Violates any laws or regulations
  • Infringes on intellectual property rights of others
  • Contains malicious code, viruses, or harmful software
  • Is defamatory, harassing, or abusive
  • Violates privacy rights of others

6. Acceptable Use

You agree not to:

  • Use the service for any illegal purpose or in violation of any laws
  • Attempt to gain unauthorized access to the service or other users' accounts
  • Interfere with or disrupt the service or servers connected to the service
  • Use automated systems (bots, scrapers) to access the service without permission
  • Reverse engineer, decompile, or disassemble any part of the service
  • Resell or redistribute the service without our written permission
  • Use the service to transmit spam, chain letters, or unsolicited communications

7. Intellectual Property

The Mark My Prompt service, including its design, features, functionality, and content (excluding User Content), is owned by Nanaji Pty Ltd and protected by Australian and international copyright, trademark, and other intellectual property laws.

The "Mark My Prompt" name and logo are trademarks of Nanaji Pty Ltd. You may not use our trademarks without our prior written permission.

8. API Usage

If you use our API, you agree to:

  • Use the API only for legitimate purposes related to accessing your own content
  • Not exceed reasonable rate limits or abuse the API
  • Keep your API keys secure and not share them with unauthorized parties
  • Accept that we may limit or suspend API access if we detect abuse

9. Privacy

10. Service Availability

We strive to provide reliable service but do not guarantee that the service will be available at all times. We may:

  • Perform maintenance that temporarily interrupts service

We are not liable for any loss or damage resulting from service unavailability.

11. Termination

We may terminate or suspend your account and access to the service immediately, without prior notice, for any reason, including if you breach these Terms.

You may terminate your account at any time by contacting us or using account deletion features. Upon termination, your right to use the service will cease immediately.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the service will be uninterrupted, secure, or error-free, or that defects will be corrected.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY AUSTRALIAN LAW, NANAJI PTY LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims arising from or related to the service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or AUD $100, whichever is greater.

14. Indemnification

You agree to indemnify, defend, and hold harmless Nanaji Pty Ltd and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your User Content

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Victoria, Australia. Any disputes arising from these Terms or your use of the service shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the service after such changes constitutes acceptance of the modified Terms.

18. Severability

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Nanaji Pty Ltd regarding your use of Mark My Prompt and supersede all prior agreements and understandings.
